4.1 Diagnostic & Radiology Services:
The collection, use and disclosure of Personal Information is governed exclusively by the Dygo Privacy Policy, which forms an integral part of these Terms. Users may, subject to prescribed procedures, withdraw consent for the use of personal data; however, such withdrawal may render the User ineligible for continued access or use of the Platform or Services.
Data Sharing and Report Retrieval Consent: The User hereby acknowledges and expressly consents that, in order to facilitate the provision of services requested through the Platform, Dygo Diagnostics Pvt. Ltd. is authorized to share the User’s personal information, medical data, and other relevant details with the designated Service Providers. The User further consents to the retrieval and collection of test reports, results, and communications from such Service Providers on their behalf, for the sole purpose of service delivery via the Platform. Dygo shall ensure such disclosures and retrievals are strictly limited to what is necessary for performance of services, and subject to applicable legal and privacy obligations. The User agrees and understands that their information may be processed and stored by Service Providers who are independently responsible for compliance with all applicable laws and standards governing the handling of sensitive medical and personal data.
The Platform is not intended to provide, nor should any Service or Content provided be construed as providing, professional medical advice, diagnosis, or treatment. No doctor-patient relationship is created by use of the Platform. Users must seek professional clinical advice for all medical needs and are expressly dissuaded from reliance on Platform Content as a substitute for medical evaluation or emergency intervention.
Users undertake to indemnify, defend, and hold harmless Dygo, its subsidiaries, affiliates, officers, directors, agents, and employees from any claims, damages, losses, liabilities, costs, or expenses arising from or related to violations of these Terms, use of the Platform, or infringement of any laws or third-party rights by the User.
All intellectual property, including but not limited to trademarks, content, software, designs, logos, and database rights are the exclusive property of Dygo or its licensors. Users are strictly prohibited from copying, modifying, distributing, or using any content or material for commercial purposes without Dygo’s express written consent.
12.1 Governing Law and Dispute Resolution:These Terms are governed by the laws of India. All disputes arising hereunder shall be exclusively subject to arbitration by a sole arbitrator appointed by Dygo, to be conducted in New Delhi, in English, as per the Arbitration and Conciliation Act, 1996 (as amended). Subject to arbitration, courts in New Delhi shall have exclusive jurisdiction.
12.2 Force Majeure:Dygo shall not be liable for failure or delay in performing its obligations where such failure arises from circumstances beyond reasonable control, including but not limited to, natural disasters, government orders, strikes, pandemics, civil disturbances, wars, or technological failures.
12.3 Severability: If any provision in these Terms is determined to be unlawful or unenforceable by a competent authority, such provision shall be severed without affecting the validity of the remaining provisions.
12.4 Assignment:Dygo may freely assign or transfer its rights and obligations under these Terms without notice. Users may not assign any rights or delegate any obligations hereunder without Dygo’s prior written approval.
12.5 Waiver: No waiver of any provision or breach shall be deemed to be a waiver of any other provision or subsequent breach.
Users may address all complaints, feedback, or grievances to the Grievance Officer designated by Dygo, whose name and contact details are accessible on the Platform and as updated from time to time.
